Aims And Objectives :
Minerals play vital role in the development of any country as they are backbone of the Industries. Rocks and Minerals also form important source materials for construction purposes. Hence it is essential that these mineral treasure of the state are identified and assessed so that their precise industrial utility is decided.
PROCEDURE FOR GRANT OF MAJOR MINERAL LICENSES/LEASES :
This governs under Mineral Concession Rules, 1960
There are two systems
a) Prospecting license.
b) Mining lease.
Reconnaissance Permit
i) An application for reconnaissance Permit shall be made in Form "A"
ii) Every application shall be accompanied by a non refundable fee.
iii) No Mining dues Certificate form the competent authority.
iv) An affidavit stating that the applicant has
1) Filed up-to-date income tax returns
2) Paid the income tax assessed on him
3) Showing the particulars of areas,mineral-wise in the state which the applicant already holds under a reconnaissance permit, has applied for but not granted and being applied for simultaneously.
Prospecting license
i) An application for prospecting licence and its renewal shall be made in Form 'B' and form 'E' respectively
ii) Every application shall be accompanied by a non refundable fee calculated in accordance with the provisions of Schedule
iii) Prospecting licenses are granted for the major minirals in the area which has not been prospected before by any Government agency. Prospecting license is granted to an agency for two years within which they have to explore the area and prepare report on quality and quantity of mineral reserves. After submitting this report they have to apply for mining lease
iv) In cases wherein some areas have already been explored or prospected by Govt. Agency, the applicant agency directly can apply for mining lease but it has to pay 25% of prospecting expenditures to government and by paying this amount, it is entitled to have prospecting report of that area.
Mining lease :
Maximum period is 30 years. After receipt of all the NOCs the lease application is forwarded to the government through the Director, Geology and Mining Department. Industries, Energy and Mining Ministry of Government of Maharashtra has power to grant the lease. After grant of lease, it is executed and this lease agreement is duly registered in the registrar's office thereafter working permission is granted by the Collector.
OCCURRANCE OF ZEOLITE
Occurrance of ZEOLITE (Major Mineral) have been reported in village Saoda of Taluka Erandol of Jalgaon District. The areas where the mineral occurres are notified by the Govt.Vide Notification dated 10th March 2005
PROCEDURE FOR GRANT OF MINOR MINERAL LEASES:
This governs under Bombay Minor Mineral Extraction Rules 1955
Application for lease should accomplished with application form along with 4 copies each
- NOC (No Objection Certificate) from grampanchayat with copy of Grampanchayat Resolution.
- 7/12 record.
- Talathi report and map of area showing applied survey/Gat no.
- Record of rights related with that applied survey/Gat no
- Solvency Certificate for minimum Rs. 1,00,000/-
- Chalan copy of Rs. 100 application fee credited in SBI (State Bank of India).
- Measurement map from TILR
- Blue print of applied area
After receipt of this application, office issue letters to following departments for NOC.
i) Town planning.
ii) B & C / PWD (Public Works Department).
iii) Pollution Board.
iv) Report from concerned Tahsildar
v) NOC from forest department if required
(THE SAME DOCUMENTS ARE REQUIRED WHEN APPLYING FOR MAJOR MINERAL LICENSEES/LEASES)
After receipt of NOCs from the respective departments lease is granted by the Collector for a maximum period of ten years with one renewal under the rule 5(1) & (2) of Bombay minor mineral extraction rules 1955. The lease deed is executed and working permission is granted.
CERTIFICATE OF NON-OCCURRANCE OF MINERAL
Industries Energy & Labour department,Govt.of Maharashtra vide its Resolution No.MNG 1099/Prakra 7778/ Udhyog-9 dated 23 sept.2003 made mandatory for all major industrial units.irrigation projects, township or any other major project to obtain a certificate of non occurrance of mineral in a proposed site form Govt./Director Geology & Minning.
(This certificate should be insisted by the authority granting Non agriculture permission, Pollution Board, MSEB, Financial Institutions etc.)
i) An application for non occurrance of mineral certificate shall be made in prescribed form in triplicate.
ii) Every application shall be accompanied by
A) 7/12 record of the land under the project B) Village Map C) Project Report
On receipt of application a site inspection is carried out by the Geologist and after scrutiny of the records about occurrance of mineral a certificate is issued by the Govt./Director, Geology & Mining.
